A few weeks ago, police in Texas responded to a car wreck in Lewisville. When they arrived at the scene, they found two pedestrians had been hit following a head-on crash on Highland Drive. Sadly, one of the victims died of his injuries.
News reports of the event shared that the victims were brothers , ages 18 and 12. They were walking home from a nearby park when an allegedly drunk driver heading eastbound on Highland Drive left her lane of traffic and struck a car in the westbound lane head-on. The impacted vehicle was forced from the roadway onto the sidewalk where it hit the brothers. Sadly, the 18-year-old died before he could be transported for medical treatment. The younger brother is said to have suffered severe injuries, but he was in stable condition when he was rushed to a hospital for care.
The individual believed responsible for this tragic event is a 31-year-old female. She was promptly arrested and charged with intoxication assault and intoxication manslaughter. She was booked into the jail in Denton County; however, she has since posted bond. It is unclear when her criminal case will go to trial.
The victims and their family used to be residents in the area and were back visiting friends and family for the holiday season. What was supposed to be a joyous time for them turned into a nightmare in an instant. This family is now trying to move forward from this crash, but they may find it challenging to do on their own, especially given all the unexpected expenses they will incur because of it. Thankfully, the laws of Texas allow pedestrians who’ve been injured in auto collisions , or — in the event of fatality — their surviving loved ones, to seek compensation for their losses. An experienced personal injury attorney may be able to help this family, through out-of-court negotiation or litigation, seek damages for their financial, physical, and emotional losses by filing claims against the driver believed responsible.
